If providers are in different practices, we apologize, as Vibrant cannot accommodate third party consultations. Only the ordering provider can schedule an educational consult and must be present during the consult as well.
A third party that needs access to protected health information (PHI) or copies of PHI to perform a service is classified as a business associate agreement (BAA). A business associate must provide reasonable assurances by means of a BAA that the requirements of HIPAA have been understood and that HIPAA Rules will be followed. However, a BAA between two providers would not extend to Vibrant.
This policy is intended to comply with CLIA regulations and HIPAA privacy rule regulations regarding protected health information. For this reason, we cannot approve a clinical consult for a third party; however, we'd be happy to assist the ordering provider with scheduling clinical consults.
